1. Who we are
Artells Magazine ("Artells", "we", "us") is an international photography magazine published by MARINA ABRAMOVA PR IZDAVANJE ČASOPISA I PERIODIČNIH IZDANJA MARIKA ART SHOW BEOGRAD, Koste Glavinića 10A, 11000 Belgrade, Serbia, PIB 113470552, MB 66848167 (the "Publisher"). These Terms govern artellsmagazine.com (the "Website") and the Publisher's editorial and publication service.
2. Website, sellers and payment channels
The Website presents the magazine, published issues, web editorials and submission options. Artellsmagazine.com does not accept or process payment. The seller and payment channel for a paid submission option is the platform identified on the order: Kavyar or Artells Media. Purchases of copies are completed through the distributor identified on the order, such as MagCloud or DPBee. The Publisher performs the accepted editorial and publication service. The applicable listing, order record and mandatory platform rules govern payment and refund processing.
3. Editorial review and options
Every submission is reviewed by the editorial team. Paying for review or priority does not by itself guarantee acceptance, publication, a cover, a particular position or publication on an exact date. After editorial acceptance, the Publisher provides the deliverables expressly listed in the selected option. Read the listing before ordering: it identifies the included deliverables, what remains an editorial decision, the expected issue or estimated delivery period and whether a print or digital copy is included.
No option guarantees sales, audience reach, press coverage, follower growth, employment, representation, awards or any career or commercial result.
4. When the service starts and is completed
The publication service starts when the Publisher accepts the application and sends an acceptance confirmation. The core publication service is completed when the relevant magazine issue is released and published on the issue page of artellsmagazine.com. Additional deliverables expressly included in the selected option remain due under that option.
5. Copyright and publication licence
The author retains copyright in the submitted work. By submitting accepted work, the author grants the Publisher a non-exclusive, worldwide, perpetual and royalty-free licence to reproduce, publish, display, distribute and archive the work in Artells Magazine in print and digital form; on the Publisher's and magazine's websites; on Artells social-media channels; in advertising and promotion of the relevant issue or the magazine; and in the Publisher's editorial archive.
The licence includes the right to crop, resize, reformat, colour-adapt and make other technical or layout adaptations needed for publication and promotion, without materially misrepresenting the work.
The Publisher credits the author using the information supplied by the submitter. The submitter is responsible for complete and accurate credits. Verified digital credit errors will be corrected where reasonably possible; already printed or distributed copies cannot be recalled.
6. Rights, releases and submitter responsibility
You must own the copyright or hold written authority from every relevant rightsholder to submit the content and grant the licence in these Terms. You must hold a written model release from every identifiable person and permission to provide the names, credits, contact details and social handles included with the submission.
If anyone depicted is under 18, you must hold a separate, verifiable written release signed by that person's parent or official legal guardian. Keep the original signed releases and rights documents and provide them promptly to Artells on request.
The submitter is responsible for third-party copyright, model, image, privacy and publicity-right claims caused by a breach of these warranties and must indemnify the Publisher to the extent permitted by applicable law. This does not exclude liability that the Publisher cannot lawfully exclude.
7. Protection of minors and prohibited content
Sexualised, nude, partially nude, sexually suggestive, sexually provocative or sexually explicit material depicting or involving anyone under 18 is prohibited without exception.
Artells may immediately reject, remove or block content and suspend processing where rights evidence is missing or a safety concern arises. Where there are reasonable grounds to suspect exploitation of a minor, Artells may preserve the minimum necessary records and report the matter to the relevant platform and competent authorities where required or permitted by law.
8. Cancellation, refunds and withdrawal
Cancellation and refund requests follow the Refund and Cancellation Policy at https://artellsmagazine.com/refund, the original purchase platform and mandatory law. Consumers may have a statutory right to withdraw from a distance contract within 14 days. Where the law permits immediate performance, the customer may be asked at checkout to expressly request performance during the withdrawal period and acknowledge that the statutory right may be lost once the service has been fully performed. Mandatory consumer rights always prevail.
9. Removal and archive
The Publisher may remove submitted or published material from its digital channels at any time at its editorial discretion. Removal does not require the recall of printed or previously distributed copies and does not invalidate uses lawfully completed before removal. A submitter may request correction of a verified digital credit error or digital removal at support@artellsmagazine.com. Requests are assessed under applicable law and the archival nature of the publication. Removal does not automatically create a refund right.
10. Complaints
Complaints about the Publisher's service may be sent to support@artellsmagazine.com. Include the purchaser's name, email, purchase platform, submission or order reference and a description of the issue. We will confirm receipt and respond within the period required by applicable law. Keep Kavyar transaction communications inside Kavyar so that the platform record remains available.
11. Website intellectual property and liability
The magazine, its layouts, logo and Website content are protected by copyright. Nothing in these Terms limits liability that cannot be limited under applicable law. To the extent permitted by law, the Website is provided "as is" and the Publisher is not responsible for the availability or independent acts of third-party platforms.
12. Governing law
These Terms are governed by the laws of the Republic of Serbia. Mandatory consumer protections of the customer's country of residence remain unaffected.
